Note that this list is in no way complete. Even if you own an SUV that is not included on this list, there is still a chance that you own a lemon, especially if you have been grappling with chronic, repeated defects and issues that the dealership can’t seem to fix. The best way to know if you have bought or leased a lemon is to speak with a California SUV lemon lawyer today.

Proving Your SUV Is a Lemon in California

How can you prove to the manufacturer, or to a court, that you are driving a lemon SUV? Here’s what you need:
  • You must prove that your SUV has been to the repair shop repeatedly, and that the manufacturer had a reasonable opportunity to fix the problem or problems.
  • You must prove that your defect was not the result of regular wear, misuse, abuse, or an accident.
  • You must prove that your defect is a material defect; that is, that it affects the use, value, or safety of the vehicle.
  • You must prove that your SUV is covered by an express warranty, and that the warranty has not expired.
  • You must prove that the material defect has not been affected by aftermarket parts.

What If My SUV Is Used for Business Purposes?

In most cases, your sports utility vehicle lemon must be used for family, personal, or private use only. However, California lemon law makes an exception for small businesses, which it defines as companies that own or lease five or fewer vehicles. If your SUV is used for business, you must also prove that it weighs less than 10,000 pounds (even the largest SUVs do not normally weigh over 6,000 pounds).

What Our Clients Say

Rating:

"Doug and Kristen were invaluable in getting GM to repurchase my Corvette due to the driveline defects in the car that Chevrolet could not fix after 9 visits. GM and the Chevy dealerships in La Mesa and Mission Valley were not helpful, giving me absurd excuses, runarounds and one time ultimately refusing to write the defects up after demonstrating them to one of their technicians. In short, I highly recommend them to handle any lemon law case you may have."
