How can you prove to the manufacturer, or to a court, that you are driving a lemon SUV? Here’s what you need:
You must prove that your SUV has been to the repair shop repeatedly, and that the manufacturer had a reasonable opportunity to fix the problem or problems.
You must prove that your defect was not the result of regular wear, misuse, abuse, or an accident.
You must prove that your defect is a material defect; that is, that it affects the use, value, or safety of the vehicle.
You must prove that your SUV is covered by an express warranty, and that the warranty has not expired.

What If My SUV Is Used for Business Purposes?
In most cases, your sports utility vehicle lemon must be used for family, personal, or private use only.
